In this notice, Chemical Financial Corporation and these subsidiaries are referred
to as "Chemical Bank," "we," "us," "our"
and "Chemical Subsidiaries."
At Chemical Bank, our mission is to provide you, our customer, with an array of
financial products and services to assist you in obtaining your financial goals.
While information is necessary to carry out this mission, we place our highest priority
and have taken the necessary steps to protect and guard the privacy of your personal
account information. Chemical Bank is confident that the following policy, required
by the Gramm-Leach-Bliley Act provides for the safeguarding of your personal account
information. Any questions you may have regarding this policy can be directed to
the Chemical Bank office with which you do business.
- Categories of Nonpublic Personal Information which we collect:
Chemical Bank collects, retains and uses information about you only for specific
business purposes. These business purposes include offering you financial products
or services, improving our existing products and services, and designing new products
and services to meet the needs of our customers. In conducting our business, we
collect nonpublic personal information about you from the following sources:
- information we receive from you on applications or other forms,
- information about your transactions with us or our subsidiaries,
- information we receive about you from our subsidiaries,
- information we receive from a consumer reporting agency, and
- information that we receive in response to requests we make to third parties about
you to confirm information that you have provided to us.
In addition, certain laws and regulations require us to collect information about
you. "Nonpublic personal information" is nonpublic information about you
that we obtain in connection with providing a financial product or service to you
for personal, family or household purposes.
- Categories of Nonpublic Personal Information which we disclose:
Chemical Bank will not, reveal nonpublic personal information to unaffiliated third
parties except as permitted or required by law. Some of the instances in which we
may disclose nonpublic personal information are as follows:
- When you request us to do so;
- When we do so to complete a transaction that you initiated;
- When we provide information to a company that provides services to us to enable
us to provide products or services to you;
- When information is provided to reputable credit bureaus or similar information
reporting agencies; and
- When the disclosure is required by law (such as in response to a subpoena).
We may also disclose all of the nonpublic personal information we collect, as described
above, to companies that perform marketing services on our behalf or to other financial
institutions with whom we have a joint marketing agreements, such as a securities
dealer.
Chemical Bank does not disclose any nonpublic personal information about our customers
or former customers to telemarketing or direct mail firms, except as permitted by
law.
- Former Customers. If you ever close your account or become an inactive
customer, we will continue to adhere to the privacy policies and practices described
in this notice
- Accuracy: Our practice is to maintain all information we retain
in a complete and accurate manner. In the event that any information pertaining
to your relationship with Chemical Bank changes or is reported incorrectly, we will
respond to your request to correct it in a timely manner.
- Employee Access: We train our employees to protect confidential
customer information. Our employees are bound by a Code of Ethics and internal procedures
that require confidential treatment of nonpublic personal information. Employees
who fail to follow the code or internal procedures are subject to disciplinary action.
- Security Measures: Chemical Bank is committed to the safeguarding
of your nonpublic personal information. We maintain physical, electronic and procedural
safeguards that comply with federal regulations to provide a secure environment
in which your nonpublic personal information is protected from being accessed by
third parties.
- Maintaining Privacy in Business Relationships with Third Parties:
It is sometimes necessary to disclose certain identifiable information about you
to a third party with whom we have contracted to help us provide products and services
to you (such as check printers). In these situations, Chemical Bank requires those
vendors, through written contracts, to maintain the confidentiality of that information.
